Types

of Investor Visas

Two distinct investor visa options are available, overseen by the U.S. Citizenship and
Immigration Services (USCIS). The EB-5 Program, established in 1990, offers a path to permanent
residence for entrepreneurs who fulfill specific requirements, including stimulating job growth and capital
investment in the U.S.

In addition to the EB-5 Program, Congress introduced the Immigrant Investor Program (Regional Center Program)
in 1992. This program allocates EB-5 visas for investors in commercial enterprises affiliated
with regional centers to foster economic growth.

E-2 Classification Visas

Another alternative is the E-2 classification, which permits citizens of treaty countries to obtain a visa by investing a substantial capital amount in U.S. businesses. To qualify, applicants must be treaty country nationals, invest a significant sum in a legitimate U.S. enterprise, and intend to enter the country solely to manage and direct the investment venture.

Demonstrating intent involves showcasing at least 50% ownership of the business or possessing operational control through a managerial position. It’s important to note that while E-2 visas are renewable, they do not directly lead to permanent residency (or a “green card”).

EB-5 Application Procedure

To initiate an EB-5 visa application, submit Form I-526, Immigrant Petition by Alien Entrepreneur. Upon filing, you have two options:

1. Apply for Adjustment of Status

Submit Form I-485, Application to Register Permanent Residence or Adjust Status, to USCIS to transition to conditional permanent residency within the United States.

2. Apply for an EB-5 Visa Abroad

Complete Form DS-260, Application for Immigrant Visa and Alien Registration, through the U.S. Department of State to obtain an EB-5 visa outside the U.S. for entry into the country.

Upon approval of Form I-485, you and your family will be granted conditional permanent residency for a duration of 2 years.

E-2 Visa Application

To apply for an E-2 visa, individuals must be nationals or citizens of a treaty investor country with the U.S. Applicants must gather necessary documents, complete Form DS-160 online, and print the confirmation page for the visa interview. Additionally, applicants must upload a photo during the completion of Form DS-160.

Following application submission, applicants must schedule and prepare for the visa interview at the U.S. Embassy or Consulate in their home country. Qualified investors may initially stay for up to 2 years, with the option to request extensions for an additional 2-year period upon meeting specified criteria.
